HabiKick Terms of Use (User Agreement)

1. Introduction

Welcome to HabiKick.

These Terms of Use govern your access to and use of the HabiKick mobile application, website, services, and AI coaching system. By creating an account or using HabiKick, you agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not use the service.

HabiKick is a habit tracking and AI-supported coaching platform designed to provide motivational, organisational, and informational support to users.

2. Acceptance of Terms

By creating an account, accessing, or using HabiKick, you confirm that:

  • you are at least 18 years old or have parental/guardian permission

  • you have read and understood these Terms

  • you agree to comply with them

  • you accept that HabiKick is not a professional medical or counselling service

Your account will not be finalised unless you agree to these Terms.

3. Description of Service

HabiKick provides:

  • habit tracking tools

  • goal setting tools

  • progress monitoring

  • AI-generated coaching and guidance

  • wellbeing and productivity support features

HabiKick is intended for personal development, motivation, and habit support only.

The service is not designed to diagnose, treat, prevent, or cure any medical or psychological condition.

4. Not Medical, Psychological, or Professional Advice

HabiKick and its AI Coach do not provide:

  • medical advice

  • mental health treatment

  • therapy or counselling

  • psychiatric advice

  • dietary or nutritional advice

  • legal or financial advice

  • professional healthcare services

All content provided through the app, including AI-generated responses, is for informational and motivational purposes only.

You must not rely on HabiKick as a substitute for qualified professionals such as:

  • doctors

  • therapists

  • counsellors

  • psychiatrists

  • dieticians

  • healthcare providers

Always seek professional advice where appropriate.

5. AI Coach Disclaimer

HabiKick includes an AI-powered coaching system.

You acknowledge and agree that:

  • AI responses are generated automatically

  • AI may produce incorrect, incomplete, or misleading information

  • AI does not fully understand personal circumstances

  • AI should not be relied upon for medical, psychological, or life-critical decisions

  • AI is a support tool only

HabiKick does not guarantee the accuracy, reliability, or suitability of AI-generated content.

You remain fully responsible for your decisions and actions.

6. Emergency and Crisis Disclaimer

HabiKick is not an emergency service.

The AI Coach and platform are not designed to respond to crisis situations or urgent health concerns.

If you are experiencing:

  • medical emergencies

  • mental health crises

  • suicidal thoughts

  • severe distress

  • risk of harm to yourself or others

  • urgent health concerns

You must immediately contact appropriate emergency or professional services.

In the United Kingdom, this includes:

  • calling 999 in an emergency

  • contacting NHS 111

  • speaking to a GP or qualified professional

  • contacting emergency mental health or crisis support services

HabiKick cannot provide crisis intervention or emergency assistance.

7. User Responsibility

You agree that:

  • you use HabiKick at your own risk

  • you are responsible for your health and wellbeing decisions

  • you are responsible for how you interpret AI guidance

  • you will seek professional advice when necessary

  • you will not rely on the app for medical or psychological treatment

HabiKick is a tool for support and organisation only.

8. Account Registration

To use HabiKick, you must create an account.

You agree to:

  • provide accurate information

  • keep login details secure

  • not share your account

  • notify HabiKick of unauthorised access

  • use the platform lawfully

You are responsible for activity on your account.

9. Acceptable Use

You must not use HabiKick to:

  • harm yourself or others

  • promote illegal activity

  • harass or abuse others

  • input unlawful or harmful content

  • misuse or exploit the AI system

  • attempt to hack or reverse engineer the platform

  • upload harmful or dangerous material

HabiKick may suspend or terminate accounts that violate these rules.

10. Data and Privacy

HabiKick collects and processes user data to provide the service.

This may include:

  • habit data

  • AI interactions

  • account information

  • usage data

All data is handled in accordance with UK data protection laws and GDPR.

By using the service, you agree to data processing necessary to operate the platform.

11. Service Availability

HabiKick aims to provide reliable service but does not guarantee:

  • uninterrupted access

  • error-free operation

  • continuous availability

  • permanent feature availability

The app may be updated, modified, or temporarily unavailable.

Features may change over time.

12. Limitation of Liability

To the maximum extent permitted by UK law, HabiKick shall not be liable for:

  • health outcomes

  • mental health outcomes

  • injury or harm

  • financial loss

  • personal decisions

  • reliance on AI responses

  • service interruptions

  • data loss

  • indirect or consequential damages

Use of HabiKick is at your own risk.

Nothing in these Terms excludes liability where it cannot legally be excluded under UK law.

13. No Guarantee of Results

HabiKick does not guarantee:

  • habit change

  • improved wellbeing

  • mental health improvement

  • productivity improvement

  • behavioural change

  • personal success

Results vary between users.

The platform provides tools and support only.

14. Account Suspension or Termination

HabiKick may suspend or terminate accounts if:

  • Terms are violated

  • misuse occurs

  • unlawful activity is detected

  • abuse of the AI system occurs

  • false information is provided

Users may stop using the service at any time.

15. Updates to Terms

HabiKick may update these Terms from time to time.

Users will be notified of significant changes.

Continued use of the service means acceptance of updated Terms.

16. Intellectual Property

All content within HabiKick, including:

  • app design

  • AI system

  • branding

  • software

  • logos

  • content

remains the property of HabiKick.

Users may not copy, reproduce, or distribute without permission.

17. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be handled in UK courts.

HabiKick Agency, Partner and Counsellor Terms and Conditions

1. Introduction

These Agency, Partner and Counsellor Terms and Conditions govern the agreement between HabiKick and any organisation, agency, counsellor, charity, service provider, or partner purchasing or providing access to the HabiKick platform for clients or service users.

By purchasing a subscription, creating organisational accounts, or providing access to HabiKick to clients, the Organisation agrees to be legally bound by these Terms.

If the Organisation does not agree, it must not use the HabiKick service.

2. Definitions

HabiKick refers to the habit tracking platform, AI coaching system, and associated services.

Organisation refers to any agency, partner, counsellor, service provider, charity, or business purchasing access for clients.

Client refers to any individual using HabiKick through the Organisation.

Service refers to the HabiKick platform, AI coaching system, dashboards, and tools.

Subscription refers to paid access to HabiKick for clients or users.

3. Nature of Service

HabiKick provides:

  • habit tracking software

  • AI-supported coaching tools

  • progress monitoring

  • engagement and support tools

  • organisational dashboards

  • wellbeing and productivity support technology

HabiKick is a technology platform only.

HabiKick does not provide:

  • therapy

  • counselling

  • psychiatric care

  • medical treatment

  • clinical services

  • healthcare services

  • crisis intervention

The platform is intended to support engagement, habit tracking, and behavioural support only.

4. Not a Clinical or Healthcare Service

The Organisation acknowledges that:

  • HabiKick is not a healthcare provider

  • HabiKick is not a therapy or counselling service

  • HabiKick does not provide medical or psychological treatment

  • the AI coach is not a clinician or professional

HabiKick is a support tool and technology platform only.

The Organisation must not present HabiKick to clients as:

  • therapy

  • treatment

  • medical advice

  • counselling

  • clinical care

5. Professional Responsibility

The Organisation agrees that:

  • it remains fully responsible for client care

  • it remains responsible for safeguarding

  • it remains responsible for supervision and support

  • it remains responsible for risk management

  • it remains responsible for clinical decisions

  • it remains responsible for duty of care

HabiKick does not assume responsibility for:

  • client wellbeing

  • clinical outcomes

  • mental health care

  • treatment plans

  • professional supervision

All responsibility remains with the Organisation and its professionals.

6. AI Coach Disclaimer

HabiKick includes an AI-powered coaching system.

The Organisation acknowledges that:

  • AI responses are automated

  • AI may generate incorrect or incomplete information

  • AI is not clinically trained

  • AI does not understand full personal or medical context

  • AI must not be relied upon for diagnosis or treatment

  • AI is a supplementary support tool only

HabiKick does not guarantee accuracy or suitability of AI-generated content.

The Organisation must ensure clients understand these limitations.

7. Emergency and Crisis Responsibility

HabiKick is not an emergency or crisis response service.

The Organisation agrees that:

  • it must have emergency procedures in place

  • it must provide crisis support pathways

  • it must provide safeguarding procedures

  • it must ensure clients know how to access emergency services

  • it must ensure professional support is available where required

HabiKick is not responsible for:

  • crisis intervention

  • emergency response

  • safeguarding failures

  • harm caused by lack of supervision

All emergency and safeguarding responsibility remains with the Organisation.

8. Client Agreement to User Terms

The Organisation must ensure that:

  • all clients agree to HabiKick User Terms

  • all clients understand the nature of the service

  • all clients understand AI limitations

  • all clients understand emergency procedures

Clients must accept the User Terms before using the platform.

The Organisation must not bypass this requirement.

9. Data Protection and GDPR

The Organisation agrees to comply with:

  • UK GDPR

  • Data Protection Act 2018

  • all relevant data protection laws

The Organisation is responsible for:

  • lawful data collection

  • client consent

  • appropriate use of data

  • safeguarding personal information

HabiKick acts as a data processor for platform services.

The Organisation acts as a data controller for client data.

A separate Data Processing Agreement may apply where required.

10. Subscription and Payment

Subscriptions may include:

  • per client pricing

  • per organisation pricing

  • monthly or annual billing

  • tiered plans

The Organisation agrees to:

  • pay subscription fees on time

  • maintain valid payment methods

  • provide accurate billing information

Failure to pay may result in:

  • suspension of access

  • restricted services

  • termination of accounts

Fees are non-refundable unless agreed in writing.

11. Use of Platform

The Organisation must:

  • use HabiKick responsibly

  • supervise client usage

  • provide professional oversight

  • ensure ethical use of the platform

The Organisation must not:

  • misuse the AI system

  • present HabiKick as therapy

  • rely solely on AI for client support

  • use the platform in unsafe or negligent ways

12. Limitation of Liability

To the maximum extent permitted by UK law, HabiKick shall not be liable for:

  • client harm

  • clinical outcomes

  • treatment decisions

  • safeguarding failures

  • negligence by Organisation staff

  • mental health outcomes

  • medical outcomes

  • misuse of the platform

  • reliance on AI responses

  • indirect or consequential damages

The Organisation uses the platform at its own risk.

Nothing in these Terms excludes liability where it cannot legally be excluded under UK law.

13. Indemnity

The Organisation agrees to indemnify and hold HabiKick harmless against:

  • legal claims

  • damages

  • losses

  • liabilities

  • legal costs

arising from:

  • misuse of the platform

  • negligence

  • failure to supervise clients

  • safeguarding failures

  • breach of these Terms

  • improper use of AI guidance

This protects HabiKick from third-party claims.

14. Intellectual Property

All software, systems, branding, and platform materials remain the property of HabiKick.

The Organisation may not:

  • copy the software

  • replicate the platform

  • reverse engineer the system

  • resell without permission

Access is granted under subscription only.

15. Suspension or Termination

HabiKick may suspend or terminate access if:

  • Terms are breached

  • misuse occurs

  • non-payment occurs

  • unlawful activity occurs

  • safeguarding risks arise

The Organisation may cancel in accordance with subscription terms.

HabiKick may terminate immediately in serious cases.

16. Service Availability

HabiKick does not guarantee:

  • uninterrupted service

  • permanent features

  • continuous uptime

The platform may be updated or modified.

HabiKick is not liable for downtime or service interruptions.

17. Updates to Terms

HabiKick may update these Terms.

Organisations will be notified of significant changes.

Continued use means acceptance of updated Terms.

18. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes will be handled in UK courts.
